Terms of Service

These Terms of Service ("Terms") govern access to and use of the FurKisses software, websites, mobile apps and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms on behalf of yourself and the business you represent ("you" or "Customer").

1. The Service

FurKisses provides cloud software for pet businesses, including grooming salons, mobile groomers, boarding and daycare facilities, pet stores and veterinary clinics. Features include scheduling, customer and pet records, staff management, inventory, point of sale, invoicing and messaging. We may add, change or retire features over time, and will give reasonable notice of changes that materially reduce core functionality.

2. Accounts

  • You must provide accurate information when signing up and keep it up to date.
  • You are responsible for all activity under your account, including activity by staff you invite.
  • Keep login details confidential and tell us promptly at legal@furkisses.example if you suspect unauthorised access.
  • You must be legally able to enter into a contract on behalf of your business.

3. Subscriptions and payment

  • Paid plans are billed in advance on a monthly or annual basis, as selected at checkout.
  • Fees are exclusive of applicable taxes unless stated otherwise.
  • Subscriptions renew automatically until cancelled. You can cancel at any time from your billing settings; cancellation takes effect at the end of the current billing period.
  • Except where required by law, fees already paid are non-refundable.
  • We may change prices with at least 30 days' notice. New prices apply from your next renewal.
  • If payment fails, we may suspend access after reasonable notice until the balance is paid.

Payments you collect from your own clients through the Service are processed by third-party payment providers under their own terms.

4. Your data

You keep ownership of all data you or your clients enter into the Service ("Customer Data"). You grant FurKisses a limited licence to host, process and display Customer Data solely to provide and improve the Service and as described in our Privacy Policy.

You are responsible for having a lawful basis to collect and store your clients' information, for obtaining any consents required to send them messages, and for the accuracy of the records you keep.

5. Acceptable use

You agree not to:

  • Use the Service for anything unlawful, fraudulent or harmful
  • Send spam or messages to people who have not agreed to receive them
  • Upload malicious code or attempt to disrupt or gain unauthorised access to the Service
  • Reverse engineer, resell or sublicense the Service except as we permit in writing
  • Use the Service to build a competing product

We may suspend accounts that breach this section, with notice where practical.

6. Availability and support

We aim to keep the Service available at all times but do not guarantee uninterrupted access. Planned maintenance will be scheduled outside peak hours where possible. Support is provided through the channels described on our website.

7. Intellectual property

FurKisses and its licensors own all rights in the Service, including software, designs and trademarks. Nothing in these Terms transfers those rights to you. If you send us feedback, we may use it without obligation to you.

8. Third-party services

The Service may connect to third-party tools such as payment providers, messaging platforms and accounting software. Your use of those tools is governed by their terms, and we are not responsible for their availability or conduct.

9. Disclaimers

The Service is provided "as is" and "as available". To the extent permitted by law, we disclaim all implied warranties, including fitness for a particular purpose. FurKisses is a business tool and does not provide veterinary, medical or legal advice.

10. Limitation of liability

To the extent permitted by law, FurKisses will not be liable for indirect, incidental or consequential losses, or for loss of profits, revenue or data. Our total liability for any claim relating to the Service is limited to the fees you paid us in the 12 months before the claim arose.

11. Termination

You may stop using the Service at any time. We may terminate or suspend your account for material breach of these Terms. After termination, you can request an export of your Customer Data for 30 days, after which we may delete it in line with our retention practices.

12. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will notify account owners by email or in the app before they take effect. Continued use after that date means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which FurKisses is incorporated, and disputes will be handled by the courts of that jurisdiction, unless local law requires otherwise.
